1. Subject and Extent of Delivery

Ordering and receiving data via digital transfer
or opening the licence seal on the packaging,
the licencee acknowledges and accepts our
Terms of Service.
TM delivers font-software on data media or via
digital transfer and enables the customer
to acquire the not-exclusive right of use for
the font-software within the terms of
the licence contract.
The extent of the particular right of use is stated
in the licence contract signed by the user.
It is forbidden to install the font-software on
computer work stations not used by the licensee.
It is also forbidden to pass the software on to
a third party or to make it available to them.
Further it is forbidden to make alterations to
the software or allow a third party to make copies
or alterations.


2. Reservation of Proprietary Rights

The right of use for the delivered data will pass
over to the customer only when the customer
has payed the total amount for the licence.
Proprietary rights for the delivered font-software
will remain with the licenser.

3. Pricing and Mode of Payment

The dispatched font-software is to be payed per
cash on delivery or bank transfer withing 14 days
after the customer has received the bill.
Prices are net prices without Tax, and they are
specified in the particular order form for the font.
Forwarding expenses to be payed by the customer
are also specified in the order form.
If payment is made from outside Germany,
the customer will also pay bank charges.
If the customer comes in default of payment,
the supplier may charge the customer 5 Euro
for every prompt note after the first one.

4. Guaranty and Liability

We want to point out that it is not possible to
develop a software in such a manner that
it will work perfectly well under any condition of use.
If the delivered font-software has a technical
defect at the time of delivery, the customer has
a right of the delivery of a trouble-free software
in exchange. If this procedure fails, the customer
may claim the contract of use to be annulled.
The customer will receive his money back.
The user will agree and engage to give back the right
of use, if the procedure described above fails or
the contract of use is being annulled; the customer
will delete the previously received fonts on his devices.
TypeManufactur expects the user to critically inspect
the delivered font-software in time, so that the user
may take on guaranty towards his customers.
As a result TypeManufactur will not pay damages
which the user is held responsible for by his customers
caused by the delivered font-software.

5. Returning Font-Software

Irrespective of any imperfections you may return
the ordered licences of use within 14 days after
delivery. Basic requirement for the return of
font-software is an untouched licence seal on
the data medium.
Font-software delivered via data transfer
(e-mail and ISDN) is excepted from being returned.
The customer’s proof of not having used the licence
is an untouched licence seal.

6. Final Clause

If any stipulation of our Terms of Service is found
to be invalid, the parties nevertheless agree that
the parties’ intention as reflected in the stipulations
is given effect to, and the other stipulations of
the Terms of Service remain in full force and effect.
